1. General

1.1 For the business relationship between us, Greenock Creek Vineyard & Cellars, 450 Seppeltsfield Road, Marananga SA 5355 Australia (hereinafter also "Greenock Creek"), and you, the purchaser from on the website https://greenockcreekwines.com. au (hereinafter also "Greenock Creek Online Shop") presented goods, the following general terms and conditions apply (hereinafter also "GTC").

1.2 Goods within the meaning of these terms and conditions are all products that you can purchase in the Greenock Creek online shop.

2. Conclusion of the contract

2.1 The presentation of the goods in the Greenock Creek online shop does not yet constitute a binding offer to conclude a contract, but merely a non-binding invitation to place an order by you.

2.2 Only adults who have a residential address in the Federal Republic of Germany, the Republic of Austria, in XXX can order.

For reasons of youth protection, we only deliver to people who have reached the age of 18.

2.4 Greenock Creek will send you an automatic confirmation of receipt to the email address you provided.

The automatic confirmation of receipt does not represent acceptance of your order, but merely documents that we have received your order.

2.5 If you choose the payment option "prepayment", a contract is concluded with us if we accept your order within 2 working days by requesting you to transfer the invoice amount.

If you choose the payment option “credit card”, the contract is concluded immediately after you have completed the order process.

If you choose the payment option “PayPal”, a contract is concluded between you and us after you have completed the payment process with PayPal.

If you choose the "invoice" payment option, the contract with us is concluded when we accept your order within 2 working days by sending an order confirmation by separate email or by delivering the goods.

2.6 Your order data will be saved by us in accordance with the statutory provisions. If you have a personal customer account, you can access your order details in the Greenock Creek online shop under "My Account". If you do not have a personal customer account and would like your order data to be transmitted, please contact us at info@greenockcreekwines.com.au. We will be happy to send you a copy of the data stored in your order.

3. Cancellation policy for consumers

You have the right to cancel this contract within fourteen days without giving any reason.

The cancellation period is fourteen days from the day on which you or a third party named by you who is not the carrier took possession of the last goods.

by means of a clear statement (e.g. a letter sent by post or e-mail) of your decision to withdraw from this contract. You can use the attached model withdrawal form for this purpose, but this is not mandatory.

To meet the cancellation deadline, it is sufficient for you to send your notification of exercising your right of cancellation before the cancellation period has expired.

Consequences of withdrawal

If you withdraw from this contract, we will have given you all the payments that we have received from you, including delivery costs (with the exception of the additional costs that result from choosing a different type of delivery than the cheapest standard delivery offered by us have), to be repaid immediately and at the latest within fourteen days from the day on which we received notification of your cancellation of this contract.

For this repayment we use the same means of payment that you used for the original transaction, unless something else was expressly agreed with you; In no case will you be charged any fees for this repayment. We can refuse repayment until we have received the goods back or until you have provided evidence that you have sent the goods back, whichever is earlier.

You must return or hand over the goods to us immediately and in any case no later than fourteen days from the day on which you informed us of the cancellation of this contract. The deadline is met if you send the goods before the period of fourteen days has expired. You bear the direct costs of returning the goods.

You only have to pay for any loss in value of the goods if this loss in value is due to handling of the goods that is not necessary to check the nature, properties and functionality of the goods.

Your right of withdrawal expires prematurely in the following cases:

In the case of contracts for the delivery of sealed goods that are unsuitable for return for reasons of health protection or hygiene if their seal has been removed after delivery

3.1 voluntary guarantee

It is not possible to taste the wine when buying it on the Internet. That is why we try to describe and classify the wines in the best possible way. In the end, of course, the individual taste decides. For this reason, you have the option (in addition to your statutory right of withdrawal) to return unopened bottles to us free of charge for a full 30 days from receipt of the goods without giving reasons. Try without risk!

That is how it goes:

Please contact us so that we can send you a return label. You can contact us by email, letter or phone.

Send us the unopened wine bottles in undamaged and originally packaged condition in suitable, unbreakable outer packaging (it is best to use our outer packaging again) no later than 30 days after receipt of the goods under the return label, free of charge. Please note that we cannot accept freight collect returns as part of our voluntary return guarantee.

After receipt and inspection of the goods, we will reimburse you for the full value of the wine bottles returned to us. Depending on the payment method, the reimbursement will be made by transfer or credit to your account. If you have not yet transferred the invoice amount to our account for payment, the invoice will be corrected.

4. Delivery

4.1 The goods are dispatched exclusively to delivery addresses in the Federal Republic of Germany, in the Republic of Austria, in XXX.

4.2 Unless otherwise agreed, the delivery period is 1-3 working days for deliveries within the Federal Republic of Germany and 3-8 working days for deliveries to the Republic of Austria, according to XXX.

The delivery period begins with payment in advance on the day on which you place the payment order, in all other cases on the day of the order.

5. Prices and shipping costs

5.1 The prices at the time of the order apply.

5.2 All prices stated in the Greenock Creek online shop are in euros.

5.3 The final prices stated in the Greenock Creek online shop include the applicable statutory sales tax and do not include shipping costs.

6. Invoice and terms of payment

6.1 You can either pay in advance, credit card (Visa, Mastercard, American Express), PayPal or invoice.

6.2 Unless otherwise agreed, payment of the purchase price is due immediately upon conclusion of the contract. When paying by invoice, the invoice amount is due for payment 7 days after receipt of the goods.

7. Retention of Title

We reserve ownership of the goods we have delivered until the purchase price has been paid in full.

8. Online Dispute Resolution and Consumer Dispute Settlement Act

9. Our liability

The statutory warranty rights apply to our goods, unless otherwise agreed below:

9.1 We are liable - for whatever legal reason - for damages or reimbursement of wasted expenses in accordance with the following provisions under letters (a) and (b):

(a) In the event of willful intent and gross negligence, we have unlimited liability. In the case of simple negligence, we are only liable for damage resulting from the breach of an essential contractual obligation (obligation, the fulfillment of which makes the proper execution of the contract possible in the first place and on the observance of which you can regularly trust and trust); in this case, however, our liability is limited to the replacement of the contract-typical, foreseeable damage.

(b) The exclusions and limitations of liability resulting from letter (a) do not apply, insofar as we have fraudulently concealed a defect or have given a guarantee for the quality of the item, for damage resulting from injury to life, limb or health , and in the case of liability under the Product Liability Act.

9.2 Insofar as liability towards us is excluded or limited, this also applies to the personal liability of our legal representatives and vicarious agents.

10. Copyrights

We have copyrights to all images, films and texts that are published on https://greenockcreekwines.com.au website. Use of the images, films and texts is not permitted without our express written consent.

11. Data protection

12. Final provisions

12.1 The contract language is German or English.

12.2 The law of the Federal Republic of Germany applies to the exclusion of the United Nations Convention on Contracts for the International Sale of Goods (CISG).

12.3 If you are a consumer, your habitual place of residence is in the Republic of Austria, in XXX and no place of residence in the Federal Republic of Germany, the mandatory consumer protection provisions of the respective country in which you have your habitual residence remain applicable.
